Lil Durk’s Bail Decision Delayed After Judge Weighs Whether He Might Flee

Lil Durk will remain in custody for now after a federal judge postponed deciding whether to release him on bail. At a hearing in Los Angeles on Wednesday, November 4, Judge Michael W. Fitzgerald said the question of whether the rapper might flee was difficult to answer and described it as “a question of psychology.” He left the request under submission, with a written ruling still to come. The hearing followed a September jury acquittal for Durk, whose legal name is Durk Banks, on murder-for-hire charges. Fitzgerald said the verdict had significantly changed his perspective and strengthened the argument for release. However, he also pointed to factors that had informed the earlier denial of bail, including Durk’s attempted trip to Dubai before his 2024 arrest. Durk’s lawyers argued that the acquittal gives him reason to remain in the United States and contest the charges still pending against him. Defense attorney Drew Findling told the court his client understands the process and wants another jury to clear him. The legal team offered music royalties, publishing income and other assets as security, and presented letters from Jay-Z and J. Cole supporting his release. Attorney Christy O’Connor argued that the proposed bond would give Durk a strong financial reason to appear in court: fleeing would mean risking future earnings and pledged assets. Prosecutor Daniel Weiner countered that Durk has the resources and connections to leave the country and continue earning money elsewhere. Weiner also argued that the rapper showed little respect for authority and could pose a flight risk if released. Fitzgerald acknowledged both sides of the dispute. While he said the acquittal may encourage Durk to trust the legal process, he also noted that a person facing another lengthy prison term might still consider fleeing. The next federal trial is scheduled for August 30, 2027. Prosecutors allege Durk was involved in violent acts connected to Only the Family, the collective he founded; his defense disputes the allegations. His lawyers also plan to challenge prosecutors’ reliance on conduct connected to a 2022 shooting involving rapper Quando Rondo, citing constitutional protections against double jeopardy. No ruling on bail has been announced.
